The short version. Use PhonePact kindly and lawfully. Be respectful in your circle — harassment, hate, threats, and other objectionable content are not allowed, and we can remove content or accounts that break these rules. PhonePact's core service remains free, and optional supporter purchases unlock private insights. PhonePact is a wellbeing tool, not medical advice.
These Terms of Use (“Terms”) are a legal agreement between you and PhonePact LLC (“PhonePact,” “we,” “us”) governing your use of the PhonePact mobile application and related services (the “App”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
Your app store’s terms also apply. On Apple platforms, your use of the App is also subject to Apple’s Licensed Application End User License Agreement (Standard EULA). Where these Terms and the Apple Standard EULA both apply, both are in effect; the Apple EULA governs the license to use the App itself. If PhonePact is offered through another app store, that store’s applicable terms also govern its distribution and billing.
You must be at least 13 years old to use PhonePact. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian. By using the App you represent that you meet these requirements.
PhonePact includes circle rooms and one-to-one private conversations between current members of a shared circle. You are responsible for the content you post. You agree not to post, send, or share content that is:
Zero tolerance. There is no tolerance for objectionable content or abusive behavior. You can report a message or block another member from within the App at any time. We review reports and act on objectionable content — removing content and/or suspending or terminating accounts — and you can always reach a human at support@getphonepact.com.
Ordinary room rows and ordinary one-to-one messages expire after 24 hours. Any current circle member may visibly keep a member-written room message for everyone for up to 30 days after it was sent. Either participant in a one-to-one conversation may visibly keep an individual message for the same period. If a message is reported, a copy of it is kept with the report so that we can review it — we cannot act on something we can no longer read. That copy is deleted 90 days after we finish reviewing the report. Deleting your account immediately deletes your private conversations, ordinary room notes and check-in rows attributed to you, and reports you filed. Reports about you may remain as anonymized safety records, with copied text attributed to you scrubbed. See the Privacy Policy for what happens to reports when an account is deleted.
You keep ownership of the content you create (messages, profile details, signature, and photo). You grant us a limited, non-exclusive license to host, store, and display that content solely to operate the App and show it to the circle or one-to-one participant you choose. You represent that you have the right to share any content you post.
PhonePact uses the phone’s screen-usage features, with your permission, to count its configured usage. On iPhone that means the Apple Screen Time scope you select; on Android, Usage Access lets you choose the whole phone or individual launchable apps in a private on-device picker. PhonePact is a wellbeing and accountability tool. It is not a medical device and does not provide medical, psychological, or professional advice. It is not a substitute for professional help. If you are struggling, please contact a qualified professional.
Supporter insights include daily and weekly views, time-of-day patterns, private app details, and an on-device pact journal in the updated supporter edition. Available measurements and history differ between iPhone and Android. Results depend on available measurements and the scope you selected; missing days, permission changes, different phones, and changes to your pact or selection can affect comparisons. Insights do not diagnose a condition, guarantee reduced usage, or prove that PhonePact or your circle caused a change. Their data use is described in the Privacy Policy’s supporter insights section.
You agree not to misuse the App, including by attempting to access it in an unauthorized way, interfering with its operation, reverse-engineering it (except where that restriction is prohibited by law), or using it to violate any law or the rights of others.
The App, including its design, text, graphics, and software, is owned by PhonePact LLC and protected by law. We grant you a personal, limited, non-transferable, revocable license to use the App under these Terms and the applicable app-store license. “PhonePact” and our logo are our marks and may not be used without permission.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limitation of liability) will survive.
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that check-ins, notifications, or Screen Time data will always be accurate or timely.
To the fullest extent permitted by law, PhonePact LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless PhonePact LLC from claims arising out of your content, your use of the App, or your violation of these Terms or of any law or third-party right.
These Terms are between you and PhonePact LLC, not Apple. Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Maintenance and support for the App are provided by us, not Apple.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Nothing in these Terms limits any consumer-protection rights that cannot be waived under the law that applies to you.
We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date, and, for material changes, provide additional notice in the App. Continued use after changes take effect means you accept the updated Terms.
