Terms of Use

The short version. Use PhonePact kindly and lawfully. Be respectful in your circle — harassment, hate, threats, and other objectionable content are not allowed, and we can remove content or accounts that break these rules. Subscriptions are billed by Apple and renew automatically until you cancel. PhonePact is a wellbeing tool, not medical advice.

These Terms of Use (“Terms”) are a legal agreement between you and PhonePact LLC (“PhonePact,” “we,” “us”) governing your use of the PhonePact mobile application and related services (the “App”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Apple’s standard license also applies. Your use of the App is also subject to Apple’s Licensed Application End User License Agreement (Standard EULA). Where these Terms and the Apple Standard EULA both apply, both are in effect; the Apple EULA governs the license to use the App itself.

1. Eligibility

You must be at least 13 years old to use PhonePact. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian. By using the App you represent that you meet these requirements.

2. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• Provide accurate information and keep it up to date.
• Tell us promptly at info@getphonepact.com if you suspect unauthorized use.

3. Subscriptions and billing

• PhonePact offers an auto-renewable subscription, sold and billed through Apple In-App Purchase.
• PhonePact is free for 30 days, counted from the day your first pact starts — Screen Time connected and at least one circle. Until then the clock has not begun. It is not an App Store free trial: we do not hold a payment method, nothing converts on its own, and there is nothing to cancel. When the 30 days end, the app asks once whether you want to keep your circles, and you are charged only if you say yes.
• Your subscription renews automatically at the then-current price until you cancel. Apple charges your Apple Account at each renewal.
• Cancel any time in your iOS Settings → Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period.
• Payments are handled by Apple under Apple’s terms; refunds are managed by Apple, and we generally cannot issue them directly.

4. Acceptable use & community rules

PhonePact includes a private “room” where you and your circle can send short messages. You are responsible for the content you post. You agree not to post, send, or share content that is:

• harassing, bullying, threatening, or abusive toward any person;
• hateful or discriminatory, or that promotes violence against any group or individual;
• sexually explicit, obscene, or exploitative — especially any content that sexualizes minors;
• unlawful, defamatory, or that infringes anyone’s privacy or intellectual-property rights;
• spam, scams, or malware; or
• otherwise objectionable or that violates these Terms.

Zero tolerance. There is no tolerance for objectionable content or abusive behavior. You can report a message or block another member from within the App at any time. We review reports and act on objectionable content — removing content and/or suspending or terminating accounts — and you can always reach a human at info@getphonepact.com.

5. Your content

You keep ownership of the content you create (messages, profile details, signature, and photo). You grant us a limited, non-exclusive license to host, store, and display that content solely to operate the App and show it to the circle members you choose. You represent that you have the right to share any content you post.

6. Screen Time and wellbeing disclaimer

PhonePact uses Apple’s Screen Time features, with your permission, to measure overall usage duration on your device. PhonePact is a wellbeing and accountability tool. It is not a medical device and does not provide medical, psychological, or professional advice. It is not a substitute for professional help. If you are struggling, please contact a qualified professional.

7. Acceptable conduct

You agree not to misuse the App, including by attempting to access it in an unauthorized way, interfering with its operation, reverse-engineering it (except where that restriction is prohibited by law), or using it to violate any law or the rights of others.

8. Intellectual property

The App, including its design, text, graphics, and software, is owned by PhonePact LLC and protected by law. We grant you a personal, limited, non-transferable, revocable license to use the App under these Terms and the Apple Standard EULA. “PhonePact” and our logo are our marks and may not be used without permission.

9. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, and limitation of liability) will survive.

10. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that check-ins, notifications, or Screen Time data will always be accurate or timely.

11. Limitation of liability

To the fullest extent permitted by law, PhonePact LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless PhonePact LLC from claims arising out of your content, your use of the App, or your violation of these Terms or of any law or third-party right.

13. Apple as third-party beneficiary

These Terms are between you and PhonePact LLC, not Apple. Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Maintenance and support for the App are provided by us, not Apple.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Nothing in these Terms limits any consumer-protection rights that cannot be waived under the law that applies to you.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date, and, for material changes, provide additional notice in the App. Continued use after changes take effect means you accept the updated Terms.
